Applying for EC from UK

Post by cskmail » Thu Jun 05, 2008 5:26 am

Hi,

I had obtained HSMP approval from India on 11th February, 2008. My EC got rejected on 16th April, 2008 under Maintenance clause. I am waiting to re-apply, as I can satisfy the Maintainence clause only by 5th July, 2008. But now the problem is, my current employer is sending me to London, UK for two months. I would be in London till 3rd August, 2008. Kindly help me with the following ques:

1. Is it possible for me to apply for EC in London, using the HSMP approval letter, I had obtained in India?

2. How much time does it usually takes to get the EC from London?

3. Can I take this risk? If BHC do not return my Passport before 3rd August, 2008, I can not return back to India. On this ground, my employer might terminate me.

Eagerly waiting for your guidance.

Thanks,
CSKMAIL

No, unfortunately, you may not apply for an EC from within the UK.

If he is on WP why cant he apply for an LTR under Tier-1 (Switch) now?

This question has been nagging many ppl ... Any thoughts?

With BIA's current processing time standing at 10 weeks / 50 working days for Tier 1 applications (yes ! that's what they are saying), I would be worried about this more than anything else.

Oh yes, this is assuming that you will coming to UK as WP holder and that you can indeed apply (switch from WP to Tier 1 with your HSMP approval letter) from within UK.

work permit holder (except the Training and Work Experience Scheme, which is a short-term immigration category).
However, I was not certain that he will be an eligible WP holder as
