Spousal visa help needed

Post by Worriedabout1 » Wed Jan 09, 2019 11:38 am

My friend is getting married in Nigeria in April and he is coming to live here once that has happened. I have read that he already needs to be living here for some time before you can apply. And as a side note, he had lived here for 14 years but his application to stay was rejected, he left voluntarily last July. I have looked on the government site but it doesn’t say what happens when the person has already been deported and/or doesn’t currently live here. Can you help? I am asking as a concerned friend.

He has to apply for a spouse visa and meet all the requirements. Does the British spouse meet the financial requirement?

Depending on his history with HO, he could still face a refusal.

Yes her salary meets the requirements. It does say on the government site that he can’t apply to come back for 1 year after leaving. Is that true? Because she has told me that he is coming back in April after they are married, 9 months after leaving!

He can only come back when and if he gets a spouse visa. Highly unlikely he will be able to return with her.

Spouse visa applications can take many months especially if an applicant has an adverse history with HO.

Hopefully it is a genuine relationship and not one we sadly read about in the papers of people being duped by online romances.

Unfortunately Char....seems no intention to live together on the Spouse visa.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Thank you.

How annoying that again not the whole story is told in one topic. I give up sometimes.

Well this will obviously end badly and appears to be a case of "marriage of convenience" only to get legal status to stay in the UK and both parties appear to be equally guilty of facilitating this.
