My wife is on the second period of her Spouse Visa (5-year route) which is due to expire in the middle of April and would be entitled to apply for ILR. However, we plan to leave the UK at the end of May as I have a new job in Asia. We are probably not going to return to the UK within the 2-year requirement of the ILR.
There is around 6-weeks between the middle of April when her Spouse visa ends and the end of May when we move abroad that my wife will not be covered by a visa. We have young children so obviously want to stay together, and work commitments mean that I am unable to leave before the end of May.
I was wondering if there was any legal way that my wife would be able to stay in the UK for this short period after her spouse visa expires without having to go through the ILR process. Could she, for example, leave and come back on a tourist/visitor visa for the last 6 weeks or so?
