Urgent Advice needed!!

Post by Sbfm » Thu Jan 10, 2019 12:01 am

Hi everyone!

I have a friend that is in need of help and i would like to ask for some guidance in what she can do.

My friend is here on a tier 4 visa and she has just finished her masters degree, her visa expires on the 28th of February 2019. The situation is she applied for a graduate job and was successful and received the job offer letter, however the company has just written to her and apologising that they are not licensed to sponsor her for the tier 2 visa and that she needs to find a way herself to get a visa to work for them, they said they will not withdraw the offer for the time being until she finds a solution.

But my understanding is without the CoS number she will be refused for a tier 2 visa. She is in a relationship with a welsh man not married yet and she is 7 months pregnant.

My advice to her was that she should go home and then she could come back on a fiance visa to get married and then make the FLR M application but she is refusing to listen. She said she will write to the home office and ask these 3 questions: 1-if she could extend her visa until she gives birth because she is 7 months pregnant and is too late for her to travel. 2- if she can use the job offer letter to apply for Tier 2 without CoS.3-if she could get an extension to get married because she has little time left.

Today they went to the register office to give notice of marriage; problem is the register office needs to notify the home office so they can investigate if the relationship is true or not which can take up to 70 days, after that if everything is fine the notice needs to be displayed for 28 days and only after that they can book to get married.

I would like to hear any advice and guidance you have so i can let her know what she can do.

Thank you so much for reading and sorry for the long text.

How long has she lived with her partner in a relationship 'akin to marriage' :?:

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Hi Casa,

They started dating in February and moved in together around July.
