Hiya

My family and I are currently in the UK as dependants on my wife's Ancestral Visa, she was recently told that she might be eligible for full citizenship.

She was born in South Africa in 1979 and her parent were married at the time

Both her parents have British passports which were acquired in 2017

Her Father applied for and received his passport in 2017, he was born in 1952 to a British born father 1916 married to a South African Born Mother (her father was British)

Her mother registered as a citizen in 2017 and then applied for and received her passport, she was born in 1956 to a South African Born Father 1922 and a British Born Mother 1923, They were married in the UK after WW2 he served in the RNVR.

Having look at all the available documentation I believe it may be possible and have considered either submit a request to determine her right to citizenship or submitting a passport application. I am loath to use a consultant as we already paid them for the ancestral visas and it is a bit of a money making racket.

In the event of it been possible I would be interested to see how it would affect me and our three SA born children who are dependants on her visa.

Any thoughts or suggestion would be welcome.

Who told her that? It may be worth asking them the basis of their thinking.

The Romein judgement which allows people to register as British citizens based on their mothers being British citizens by descent only apply to cases when the mother was a British citizen by descent before 1983 AND at the time of the birth of the child.

Could you explain your thinking a bit more clearly? Which Registrar? What was their thinking/logic? Can you speak to them again and ask them which form/section of the law do they have in mind?
