Help Needed for ILR Application

Post by Moash999 » Fri Jan 11, 2019 12:57 am

Hi this is my first post and I am hoping somone can help me.

Background: My wife got entry clearance for spouse visa and entered UK 09/02/2014 on a 2.5 year visa within a month of visa being issued.

Applied for FLR and visa granted with expiry 27/04/2019.

1. When can my wife apply for ILR? I understand it is within 28 days before 5 year anniversay of entering UK? Is this correct. If so can she apply from 12/01/2019?

2. I have started an online application but will not submit before dates confirmed. If I apply (submit) after 12/01/2019 she will have been in the UK 4 years 11 months. Should i put 4 years 11 months or 5 years on the form?

3. Accomodation: we have been living in a housing association house with my parents and the tenancy is in their name. My father will give a letter stating that he is happy for me and my wife to live with them in the house. We do not pay rent as my dad gets disability allowance and the council has exempt us from paying rent. On the online application the options are Own, rent or neither own or rent. If i select the last option it asks me to provide mortage letter etc and letter from owner even though we did not provide this for the FLR application. but if i select the rent option i have to input a rent figure and it does not accept zero. What should I do in this case?

4. Employemnt. I changed employemnt in the past 6 months therefore applying with 12 months payslips. Do I need to provide a letter from my previous employer or only my current employer? Can it be signed by my manager or does it need to be the HR department?

Sorry for all the questions but im stressing with the above issues. Your help is appreciated.

Thanks

Hi Moash999,

Regarding point 3. I am having the same issue. What was your resolution and was the letter from your parents sufficient? Because the immigration solicitor i saw said the letter from parents is fine and don't need letter from housing association, but others have said I must get a letter from the housing association giving us permission to stay.

Thank you.
