My wife came to the UK on a spouse visa February 2017, and her FLR expires November 2019. Her son (my stepson) joined us in June 2017, but his FLR has the same expiry date as my wife (November 2019). This means that he won’t have been in the UK for 2 ½ years when he needs to apply to extend his FLR.
We are planning to apply for the extensions one month before expiry, but even so, I don’t see how he can complete 5 years in the UK before his second FLR expires in, say, April 2022. My wife will be OK, but he won’t be.
1) Can my stepson apply to extend his FLR alongside my wife, before he has completed 2 ½ years (I assume yes, otherwise he will be here without a valid visa)?
2) Will he be able to apply for ILR when his second FLR is coming to an end in March-April, even though he has not completed 5 years in the UK? If not, what will he have to do?
