Visiting My Spouse in the UK?

Post by suchsharpteeth » Thu Jan 10, 2019 11:27 pm

I'm American & live in the US; my fiance is British & lives in the UK. We will be getting married this year, then he'll be applying for a visa to join me in the US.

After we are married & waiting for his visa to be approved, I'd like to be able to visit him - but I am worried that I'll be denied entry by border control, & they'll assume that, as newlywed visiting their British spouse, I must be planning to settle there illegally. Am I being paranoid? Are there specific steps I should take to demonstrate I have no intention of staying long term?

I'm established in the US in as far as I have a full time job (my career is the primary reason we're planning to live there), as well as a lease. I know return flights are not considered indication of intent, but I never visit for longer than two weeks (the max time I can get away from work), and I always book a return flight. Our lawyer can likely provide documentation regarding our plans to live in the US. Once he starts the green card application process, it would be very difficult & risky for my fiance to visit me, so my ability to travel freely is pretty important to us. I've not been able to find any concrete answers on this, so any insight you could provide would be much appreciated. Thanks!

Providing you are able to convince the Border Control Officer that you have stronger reasons to return to your home country than you have to stay in the UK, you should be permitted entry. Have evidence of your ongoing employment in the US with you when you travel.

Something to consider when you're posting on the forum...both of your posts have been in the middle of the night in the UK, when many members in the European time zone are sleeping.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
