Wife's Visa and New Born Child (Outside UK) to a British Father and Indian Mother

HI,

I am UK citizen and living in UK. MY Wife had "Family of Settled Visa" and she recently went to India for her delivery. Her "Family of Settled Visa" expired recently.

1) My baby is born in India (I am holding British Passport and my wife holding Indian Passport) and currently residing in India , will my new born can become British citizen if so, please let me know the process and steps.

2) If i get Indian passport first, what visa should i need to apply for my new born to get her to UK? (Cost of this visa seems to be very expensive)

3) My wife's "Family of Settled Visa " is expired now and she is in India. Do i need to extend or apply her "Family visa" as a fresh? How long this process takes?

4) I want my wife and my new born to travel together from India, If Initial visa is given for 30 days, how best can i apply together?

1. Child is British by Descent if born AFTER you became British.

2. You can apply for Certificate of Entitlement or Right of Abode.

3. She has to start again from scratch with a new visa and a new 5 year route to ILR. Note also that IHS fees have doubled recently.

4. Apply for baby as per number 2 above, it is quicker than a British passport and the above does not expire in 30 days. Wife's visa could take a couple of months.

One question, If i apply Certificate of Entitlement/Right of Abode, Do i need to get any passport when my baby is travelling to UK from India? or Just Certificate of Entitlement is sufficient (without passport) to travel to UK from India? Kindly clarify.

You will need an Indian passport to be able to apply for CoE or RoA, which is a vignette stuck into the passport. The child also needs a passport to travel. CoE/RoA is not a travel document.

Thanks a lot for your quick response. I will apply Indian passport first and then followed by CoE/RoA.

One last question, if i travel to Europe as part of Tourism , do i need to apply for Schengen visa? Or CoE/RoA is treated as a British Citizenship and no visa is required.

Note: Above question is based on current policy and not after Brexit.

Child wil still need a Schengen visa.

Once child is in the UK you can apply for British passport using one week fast track service.
