This is an immigration internet forum, with volunteers offering advice. This is not an official immigration lawyer site.

If you state the exact wording of the refusal excluding personal information, we can offer some advice.

Also if you can state the circumstances that lead to this application being made in the first place as it is the hardest visa to get and the refusal has also now effectively shut the door on any future visit visa applications.

Hi CR001,

Thank you for your reply. Apologist for late response, I am not familiar to this site and had to spent more time to find your reply.

These are the info in refusal letter.
***********************************
EC-DR.1.1(c) - Suitability entry clearance requirement - Met
Financial Requirement- Met
EC-DR.1.1(d) - Relationship requirement
  • you have provided a birth certificate of (Applicant's daughter's name) which states you as being her mother. You have also provided a copy of her passport and BRP that she has leave to remain until May 2019. You have states your sponsor is your son-in-law who has ILR.
Immigration officer then explain further about the rule for relationship has not met.
  • You have provided a letter from family medical clinic that you require long term care I must be satisfied that this care cannot be received in your home country. The medical issues outlined in the letter are unclear.I am aware that treatments available in Sri Lanka for wide range of medical issues. Provision for personal care can easily be made in SriLanka. You have provided no evidence to show you are receiving financial support from your daughter or sponsor. Therefore I refuse.
Also no TB certificate to show that you are free of disease.

I have also considered your application under article 8. I note that no satisfactory reason has been put forward as to why the sponsor in the UK unable to travel to Sri Lanka. I have therefore refused your application that I am not satisfied.
************************************

But CR001 to let you know I understand the relationship issue. But I was given some legal advises by a solicitor at the time I apply the visa that it want be an issue as this must be considered under article 8. The other info are wrong we have provided bank transfers and mothers bank statement that we have provided finance each month since 3 years. We have explained why we cannot go back to SL for living we have 2 children who has only British Citizen and No SL citizenship for them and my daughter 9 years old) only speak English. And even my Son (3 years old). We also provided TB certificate with application.
Even now My husband has only British citizenship no more SL. We both are working here. My mother is 83 Y old now living along in SL. My farther died when I was 5 years old since then both my mother and me lived along in SL and I got married and had to come to UK 9.5 years ago. Since then she lives along there in Sl. Not she in passing a had stage and we all suffered living in 2 ends.
Can you please advise me a way yo get this success.

Thank you.

What do you mean by "Not she in passing a had stage" :?:

How severe is her disability? Is she able to bathe, dress herself, prepare food and manage other daily tasks without assistance?

Sorry it is a typo error - Corrected as "Now she in passing a hard stage" means she is passing a difficult time. She lives in my home and she is cared by a local lady comes in the morning and do her work and go in the evening but not a proper carer like in UK. She has various medical conditions like high blood pressure. diabetes and also Dr says she has a developing condition to dementia. Dr has advised us that my mother not taking her medicine well and she refused them. Dr has provided a letter mentioning all of these conditions and she now need caring of her family.

Thanks.

Which Immigration form to fill in to submit passport after an appeal overturned

Post by waruni100 » Wed Jan 16, 2019 10:09 am

Hi,

This is regarding my mother’s visa application. She is a Sri Lankan and her visa application was made an year ago.
It was rejected but appealed and now appeal overturned and we have been advised by UK Decision making team to submit her passport along with the UK home office email confirmation.

We have visited vfs Sri Lanka Office (Sri Lanka official partner of UK Visas and Immigration) and they did not accept the passport and asked to bring them with “immigration form” filled in. But when we asked which immigration form they refused advising. So we do not know what immigration form they are referring to. Can you please advise on this what form is required to fill in?

If you know the link for the
Thank you so much
