ILR via Tier 2 General

Post by andrewmadurai » Wed Jan 16, 2019 9:11 pm

My apologies if this thread is not appropriate for these questions.

1) My wife is on a Tier 2 general principal visa- her visa was issued on 1st of June 2015 and she entered UK on 15th June 2015- We have been advised by her Employer that she will be eligible to apply for ILR in early May 2020. Is this true. She has not being out of the country for more than three weeks in any calendar year so far.

2) Myself and our son received our visa on 10th October 2015 and we entered on 15th October 2015- I have been advised that I will only be able to apply for ILR upon completing 5 years from 10/10/2015. Our question is would this be true for our Son as well (He will below 18 in October 2020). I was under the impression that the 5 years rule does not apply for children under 18 and that he will be able to apply with my wife in early May 2020 or just after she receives her ILR even though he would not have completed 5 years.

3) All of our Biometrics are valid till Mid July 2020

Thank you very much in advance for your advise

I have split your post to its own topic. Please don't tag onto other members threads, it is unfair to other users.

1. Your wife can apply for ILR, if she meets all the requirements, no sooner than within 28 days before the 5th anniversary of her first fist ISSUE date.

2. You and your son will only qualify to apply for ILR no sooner than within 28 days before the 5th anniversary of your first dependent visa ISSUE date. The 5 year rule doesn't apply to children (strictly), however they will follow the same route as the less privileged parent in immigration terms, i.e. you.
