claming asylum

Dear friends, i came to uk in 2009 as student, then after completing my studien in 2012. I applied for psw. Then after psw I applied for entrepreneur visa but it was refused then appeals & judicial review also refused. After that I applied for flr hro, and again it was refused and appeals & judicial review is also refused. I am with my family from 2012. I have three kids all born here in uk. I am over stayer from January 2017. All family passports expired. My question is best option for me to further leave in uk. I can’t afford any more fees because my economical position is very poor. If I applied for asylum. How can apply and get success. Please give me best suggestions if you can. Thanks

On what basis do you believe you qualify to claim asylum??

Asylum is not a 'golden ticket' to stay in the UK and the fact that you have been here for almost 10 years with visas might count against you.

Why was your entrepreneur visa refused?

If you expect any useful advice from members, you should post your full UK immigration history including all dates etc and reasons for refusals.

Thank you for your kind answer, from feb 2009 to july 2012 on student visa. Then from
July 2012 till july 2014 on psw. Then I applied for entrepreneur visa but was refused in December 2014 on credibility of business plan and application. Then i appealed in lower tribunel which was accepted but home office appealed in upper tribunal and again my application was refused. Again I applied for judicial review which is also refused in jan 2017. I was overstayed for a month Then I applied for flr hro, but it was refused again I appealed in upper tribunal but it was again refused then again I applied for judicial review and it was again refused in August 2018. My wife is with me from last 6 year, also my three kids was born here. My elder son is of 6 years. Can I applied for asylum on family basis. Or what are best options to stay further in uk. Thanks

In what scenario do you believe you have an asylum claim?

It's a pure waste of money and it'll only lengthen your time in the UK as an overstayer subject to the extreme hostile environment.

What is your partner/wifes nationality?

If your child was born in the UK by 10th birthday can be registered as a British national. However, it's long and expensive route

Based on family route depends solely on what exceptional circumstances there are. Having children isn't enough brother.

08/16 - FLR (FP) Partner, refused 02/18, 03/18 - JR permission refused with merit
08/18 - FLR FP (Partner) PSC - Approved
07/20 - FLR FP to FLR M Switch - Approved, 03/23 FLR M Ext Approved.

Thanks for your reply, Can i lengthen my time via asylum because I belongs to northern area of Pakistan, and after when my son was of 7years then i change my circumstances and apply on child route. I am hopeless I don’t how i stay in uk now.

You've written above your child is 6. Now 7? Have you applied for the 7 year route now?

If you're from northern part of Pakistan, there's many areas you can move to. That is what the home office will say. You've not had a long time in the UK just messy long cases which has wasted a lot of your time and money to be honest

The bottom line is that an asylum claim with no credible backing or reason will make your history much worse. If you've put in a child route be patient on this then. Don't claim asylum to "lengthen your time" here

My child is now 6 year old and I mean if i stay one year after claiming asylum then I will able after one year to apply on 7 year route. I agree with your comments that my history will be worse, but i loss everything in fighting these cases. Now I have housing issue , job issues, nhs issues and many. Ignore asylum, In these circumstances what are best options for me.

Take your chances and wait until child is seven.

Have you been given immigration bail to report..
