HSMP holder- how much stay required.

Post by uiqbal » Sun Jun 08, 2008 3:55 pm

Hi,

I got hsmp visa on 8th january 2008 and I entered uk on 4th february 2008. Then after getting the job i went back to my home country on 5th March 2008. I started my job on 21st April and arrived on the same date.

Now i would like to know that how much longer i have to stay in UK. If i intend to go for holiday of 1month in november/december 2008. Is it ok?
Would that effect my extension application in any way?

Could anybody give me the detailed guidance and rules about that?

Waiting for your prompt reply.

Regards,
uiqbal

Correct me if I am wrong but the question here seems to be about FLR and not ILR.

Yes it is about FLR application after 2 years. Could somebody give me some information about it, as it is very important and I have to book my flights and stuff.

Thanks

Effectively,
FLR is governed by the same set of rules as the LTR/EC so when your current ltr comes o an end you will be submitting all the proofs like earnings/age/qualification (if different from the one submitted at the time of initial approval).

Tier-1 VISA dos not put any kind of restriction on the number of days that you spend outside UK (atleast not that I know of) and the FLR will be judged onthe basis of your circumstances when the current leave expires.

Short answer- you can happily go on a holiday.

But remember that your stay in UK however counts towards the mandatory period (presently 5 years) that you need to spend in
uk before you apply for an ILR.
