Applying for British Citizenship for ILR dependant

Post by Mariam Javad » Mon Jan 21, 2019 1:53 pm

Hello
I got my ILR (via 10-year route) in 2017 November and is planning to apply for Citizenship now. My husband came to UK in 2013 and was on PBS dependent visa. He got ILR dependent visa on November 2017. Can he apply for Citizenship along with me as he was in UK for last 5 years (with no breaks)? Or can he apply for citizenship immediately after I got my citizenship? Please advice.
Thank you.

No he cannot. He needs ILR before he can apply for citizenship. To get ILR, he needs 5 years on his current dependent visa route and will only qualify for ILR in November 2022.
Or can he apply for citizenship immediately after I got my citizenship?
No he cannot. He needs ILR first.

Thank you for your response.

In the UK gov website it is mentioned that 'You can apply for British citizenship by ‘naturalisation’ if you:
are 18 or over
are married to, or in a civil partnership with, someone who is a British citizen
have lived in the UK for at least 3 years before the date of your application'.

So once I get the citizenship can he not apply as spouse of British citizen?

Please clarify this. Thank you so much.

No he cannot. There is a MANDATORY requirement for ALL applicants to hold ILR or PR when they apply for citizenship. There are NO exceptions to this for those on visa routes to ILR and citizenship.

You can apply for British citizenship by ‘naturalisation’ if you:

prove your knowledge of English, Welsh or Scottish Gaelic

indefinite leave to enter the UK

You need to read the whole set of requirements, not only the bit you believe is applicable.
