Tier 1 Entrepreneur ILR (5 Years route)

Hello everyone. I am new to this forum and have got couple of question:
1: Under the new rules (Online application), can we go for Next day service or 1 day decision service for Tier 1 Entrepreneur ILR?

2: I have the initial visa Oct-2013 then applied on Oct-2016 for my extension and got the extension on Mar-2017 and which is finishing Mar-2019. Now my question is I have 3 points on my driving license (Dec-2016) and 100 pound fixed penalty issued by wales police not from court (I was driving 33 mph on 30 mph road) and speeding code is SP30. Is it a problem for ILR application? Do I need to disclose it at all?

3: And on the SET O online application form, do I need to mention all absences (Even 2-3 weeks absences) since entry to this country or just last 5 years absences only?

3: And on the SET O online application form, do I need to mention all absences (Even 2-3 weeks absences) since entry to this country or just last 5 years absences only? Absences during your last 5 years qualifying period date will be 5 years backwards from the date of application

Thanks tier11417 for you quick and nice answer. Just a little confusion about the absences. As I came to this country under Tier 4 visa on Sept-2009 and went back to Bangladesh for 1 year (but I had my PSW visa on that time, I mean when I was in Bangladesh) then came back to UK on July-2013 again and got the Tier 1 Entrepreneur visa on Oct-2013.
So should I not disclose all of my absences since the first entry date? or just last 5 years? Because application form is asking since the beginning. And if I have more than 180 days absences before my qualifying period (Means not in last 5 years) then is it a problem?

Your ILR application is based on Tier1 ENT.. for the purposes of this application only the absences within that period are to be listed..

You will list 5 year absences based on your Tier 1 Ent visa. Count 5 years back from the date you apply. You can not have more than 180 days/year absence in these 5 years.
However, you have to list all the countries including your country of birth where you have lived OUTSIDE UK in another question. You will list bangladesh in that since you lived there for 1 year or any other place also where you lived for e.g work, study etc NOT short trip like tourism etc. But I would assume 1 year will be considered as living in bangladesh.

Because the online application form and the manual form has got some differences. Please see the following questions from the Online application form and help me to fill it up correctly please:

1) When did you first enter the UK? Because they are not asking which application is based for, but in the manual form they mentioned particularly that based on qualifying period. So, Do I Need to put when I came first here or when I got my Initial Tier 1 entrepreneur visa? Like Oct 2009 (Came here as student) or Oct 2013 (Got Tier 1)

2) Since you first entered the UK, have you had any absences from the UK? Shall I start from 2009 or 2013?

3) What evidence will you provide to support the reasons for all absences from the UK and Crown Dependencies? If I put answer other, then if I answer like this "As I am applying settlement through Tier 1 Entrepreneur, so I am exempted to provide any evidence. Also, in my last 5 years qualifying period I was not absent more than 180 days in any 12 months calendar." is it ok?

4) Have you previously lived in a country outside the UK including your country of birth? This question was never asked in the manual form before. What will be the answer, is it Yes or No? and If answer is yes can I answer like this: "I was born there and lived there until came to UK for study purpose"

It is based on TIER 1 and is explained as well in the guidance which it previously wasn’t.

The last line is unnecessary. Evidence not required.

I believe you should answer those questions strictly based on the instructions in the guidelines for Tier1 and SetO, you don’t need evidences of absence but star them and the reasons. It will be good if you do it on a spreadsheet kind off. We have numerous samples on the platform that has worked for most people.

As regards your SetO application, since you are applying through Tier1 I believe you should reckon with the date you are granted Tier1 visa or when you entered after grant of Tier1 whichever is best for you.
