ILR

Post by Saba_24680 » Fri Feb 15, 2019 7:37 am

Hi
I came in uk back in 2009, till 2014 i was getting my student visa extended, due to change in circumstances i appied asylum in 2014 before my visa expired.
My asylum application was refused initionally, i did appeal and won that. Home office then appealed in upper tribunal but judge in upper tier tribunal gave judgement in home office favour.
In 2017 i put new application while my previous application was in court of law.
Homeoffice granted me refugee status on my new application.
My concern is, i applied asylum can i go on 10 years route as its been 10 years in uk
Can anyone please guide me on thanks matter
Thanks & goodluck to all

What are the exact dates of the sequence of events in this?

Ehat date exactly did you apply in 2017 and what application exactly did you make?

What "Court of law" process are you referring to?

I applied asylum in 2014 august

In june 2017 i submitted new application and in september 2017 home office granted me refugee status

I did ask for all the exact dates. This is useful if you expect any worthwhile advice from strangers on an internet forum.

All i would like to ask is
That if someone got refugee status can they go on 10 years route for ilr
I can apply for ilr after 5 years of refugee status, my concern is can i do that earlier on basis of my 10 years in uk ?

The reason we ask for exact dates is that once your appeal rights were exhausted, your Section 3C protection ends and you become an overstayer.

ILR based on 10 years long residence requires the full 10 years to be in the UK with LEGAL residence.

If you don't wish to state all the important exact dates and what 'court of law process' you are referring to, I will leave others to try and guess your circumstances and respond.

One last thing
What i understand from our previous conversation is, that if i stayed legal and never been over stayed all the time of my first refugee status and court hearing timings will count valid for ILR?
