UK Spouse Visa - Advice w.r.t company specified in paragraph 9 of FM-SE

UK Spouse Visa - Advice w.r.t company specified in paragraph 9 of FM-SE

Hi,

I was about to file my spouse visa application to join my wife in London when we realized that my wife's employment falls under the category - limited company specified in paragraph 9(a) of FM-SE. In short, my wife in an employee in her father's company. I understand that we have to provide a lot of other documentations w.r.t the company itself such as Company Tax Return CT600, annual audited accounts for last financial year etc. (basically the requirements of paragraph 9(b)-(e) of FM-SE).

My question is related to this requirement:

9(c) Where the person is either listed as a director of the company, or is an employee of the company, or both, and receives a salary from the company, all of the following documents must also be provided:
(i) Payslips and P60 (if issued) covering the same period as the Company Tax Return CT600.
(ii) Personal bank statements covering the same 12-month period as the Company Tax Return CT600 showing that the salary as a director or employee of the company (or both) was paid into an account in the name of the person or in the name of the person and their partner jointly.


My wife started working from my dad last august when she shifted to London. So she does not have payslips, BS etc. for the full financial year (April 6th -April 5th). She will meet the GBP18,600 threshold with 8 & 1/2 months of pay when we apply in April at the close of the financial year. We have payslips, BS etc. for that period.

Will it be sufficient to explain to the Home Office that she has not worked the full year & that's why we don't have the documents from the period before August. Again she meets the GBP18,600 threshold with 8 & 1/2 months of work.

Or does she need to work a whole year with the company & we will only be able to apply at the close of next financial year (in April 2020), when both company accounts & her 12-month job period will be the same.

Hi

I would have thought that as long as she earns the £18,600 then then its ok to send the documents since August. Surely the threshold hold amount of £18,600 is the thing they require. Good luck. Maybe you can phone or mail the immigration office if you still have doubts?

I also have the same issue as you
please can someone help
I have 7-8 months wage slip
but my wages are not involved in the full tax year
