Help!!! Tier 4 student visa to ILR - what about child dependent

Hello,

I have met the conditions for ILR (10 years long residence) but visa still valid till Dec 2020. I would like to apply for ILR BUT a bit confused about how to deal with child dependent (10 YEARS OLD) who is yet to meet the ILR continuous residence in his own right

Please see his migration history:

He was born in Ghana (07/12/2008), first entered the UK on 01/02/2009, lived in Ghana for about 10 months at a stretch 20/01/2010 - 09/11/2010, breaking the continuous leave in UK. Since November 2010, he has been in the UK till date only leaving the country for a total of 153 days

Questions

1.If i make the ILR application, will his Tier 4 dependent visa still remain valid up until it expires in 2020 and then he can apply for ILR or would my application reset her own time to zero

2 If his visa is invalid after a successful ILR application,

a) what application can I make to extend his stay in the UK to make up 10 years residency without additional requirements to remain in the UK for another 5 years or so

3 How much time do i have to make another application for him?


I would appreciate any help in this matter

I have read the attached links. Does it mean that my son can remain on his tier 4 dependent visa until 2020 when he will be due to apply for ILR.

I am not sure what to make of your reply. The other parent is back in Ghana and only comes to visit with a Tier 4 dependant visa

Hello Moderators

I need your help urgently. I am due to apply for ILR in March 2019 but my child will meet the conditions of ILR in his own right by November 2019. My Tier 4 visa is valid until 2020 and both my partner and child are my dependents (Partner does not live in the UK)
