Tier 1 General defendant to PBS depandant

Post by cvs » Sat Feb 23, 2019 7:33 pm

Hello,

First of all sorry, i asked too many questions here, and thanks a lot for helping.

My Wife came to UK October 2014 with Tier 1 General Dependent Visa which was granted September 2014. We got extension in the UK in May 2016 and got the extension visa till May 2019. Now i'm planing for extension again as she is eligible for ILR in October 2019 (Sort of 3 to 4 months).

But i noticed that now Tier 1 General dependent visa not exist.

1) Do i need to apply PBS dependent visa for extension?
2) If yes for Question 1, does she need to provide English Language proof for PBS dependent Visa?
3) If yes for Question 1, does she eligible for ILR in 4 months even though she switched Visa?

Either PBS Dependent or ILR, she might need to prove the English language requirement. She finished M.tech in India, but the certificate doesn't mention any thing about completed language even though its in English.

a) Does it require a separate letter from university confirming that the course was taught in English as it
mentioned in Gov.UK website ? or India degree original certificate + NARIC certificate is sufficient?
b) I noticed NARIC red route is for applying for this. But i confused about selecting
Immigration route. Please help me to select the right name for submitting Indian degree for
eligibility for English language requirement.
* Statement of Comparability,
* Upgrade Translation Waiver Service for Statement of Comparability,
* English Language Assessment,
* Statement of Comparability for Construction Skills

c) Do i need to get certificate for both bachelor & M.tech or one is sufficient?

If it is PBS dependent application, as for as my research supporting documents are same like tier 1 general dependent.

Maintenance funds for 3 months, Address proof (living together), No Employment documents required for me and my wife as i'm in ILR and she is taking care of daughter

Please advise.

Thanks!

What was the initial visa ISSUE date in 2014?
But i noticed that now Tier 1 General dependent visa not exist.
Tier 1 General MAIN applicant is NOT available. Tier 1 G Dependent is STILL available.
1) Do i need to apply PBS dependent visa for extension?
Yes, she has to apply for an extension. It will be a 3 year extension. She also has to pay IHS which has doubled and is £1200 for a 3 years extension plus the visa fee of £1,878.
2) If yes for Question 1, does she need to provide English Language proof for PBS dependent Visa?

No. It is required for ILR though plus LIUK
3) If yes for Question 1, does she eligible for ILR in 4 months even though she switched Visa?

She can apply for ILR when she meets the requirements, no sooner than within 28 days before the 5th anniversary of her initial visa ISSUE date, hence my question.
Either PBS Dependent or ILR, she might need to prove the English language requirement. She finished M.tech in India, but the certificate doesn't mention any thing about completed language even though its in English.

She needs the English B1 test or she needs UKVI NARIC Red Route, ELA and Comparable assessment, costs £150, the same as B1 test.

See my comment above.
b) I noticed NARIC red route is for applying for this. But i confused about selecting Immigration route. Please help me to select the right name for submitting Indian degree for

NARIC Red Route.

You only need to assess ONE degree.
If it is PBS dependent application, as for as my research supporting documents are same like tier 1 general dependent.
PBS Dependent is the same as Tier 1 General Dependent.
Maintenance funds for 3 months, Address proof (living together), No Employment documents required for me and my wife as i'm in ILR and she is taking care of daughter

No employment docs for spouse.
Please advise.

>What was the initial visa ISSUE date in 2014?

Its 04th September in 2014. So 28 days time period before 04th September 2019.
