Hello all

When reading on ILR on the government website, it says we must first know what route we are on. It said this information would be in papers we've received from them when we renewed the wife's Spouse Visa.

I went through all the papers, this information is not mentioned. So right now, I do not know what route my wife is on.

Here is a copy/paste from the website.
You can apply as the partner of a British citizen or person settled in the UK
You may be eligible for settlement (indefinite leave to remain) if your partner is:

a British citizen
settled in the UK

Your current UK visa must be based on being their partner - this includes being:

their husband or wife
their civil partner
in a relationship that’s like a marriage or civil partnership
You must prove you’ve been living together since your last visa renewal. You must also intend to continue your relationship after you apply.

Eligibility
If you’ve got a family visa as a partner or spouse on the 5-year route, you must have been living in the UK for 5 years.

If you’re on the 2-year route, you must have been living in the UK on that visa for 2 years.

If you’re on the 10-year route, you must have been living in the UK on that visa for 10 years.

If you’re not sure which route you’re on, check the letter you got from the Home Office when your ‘leave to remain’ was last approved.

Read the guidance about applying after living in the UK for 5 years or 2 years.

Knowledge of language and life
If you’re 18 to 64 years old when you apply you must also:

pass the Life in the UK Test
meet the English language requirements

Your previous posts suggest she is on a Spouse settlement visa, ie 2 x 2.5 year visas, which puts her on the normal 5 year route to ILR. If she applied for her spouse visa abroad on form VAF4A and then extended on form FLR(M), it is the normal 5 year route.

Thanks, immigration history like what?

She arrived in the UK on a Spouse Visa in Feb 2015. After that expired, we renewed it (she got a BPR through that).

That is what she is currently on. This will expire in a year or so.

I am researching from now, cause I want to be ready with all the paperwork ...etc.

She is on the normal 5 year route spouse visa. She can apply for ILR no sooner than within 28 days before the 5th anniversary of her date of entry to the UK and meet the English B1 and LIUK test requirements and the income requirements again.

Thank you CR001. It is great that you've helped us clear that up.

Income is fine, Life in the UK Test is fine, and English B1 is fine (I think because she applied for something similar when she got her first Spouse visa).

I am concerned about this.
You must prove you’ve been living together since your last visa renewal.
How do we prove that we've been living together? The quarterly water bill is in both our names. TV Licence used to be in her name, but about 3 months ago we cancelled that because we never watched any English live TV, we only watch YouTube, Netflix and Amazon Prime.

We don't have any medical issues, so we hardly go to the doctor and even then, it is over the phone, so you don't get any appointment letters from the GP.

Her bank statements are digital (Nationwide), but they do show the same address as mine, so if they accept digital bank statements, we're good.

My own personal bank is Starling and is all Digital, there is no branch, but again I can export CSV and PDF statements right from within the bank mobile application. Again this is fine if they accept digital bank statements.

Not sure what else we need to prove we live together.

ANY letters addressed to you jointly or individually at the same address for the 2 years preceding date of ILR application, even services you have cancelled such as TV licence. Also tenancy agreements or mortgage statements, HMRC correspondence etc.

The mortgage is in my name only, but I'll go and look back and create a folder of evidence.
