I just wanted to check advice with anyone what to expect from my wives ILR Application
She arrived in UK on Fiance VISA November 2013
She got Spouse VISA March 2014 (5 year route)
She applied for ILR in January and then went to the premium centre on 30th to do fingerprints etc and they told her she would know within 24 hours. 24 hours later she gets an email from UKBA to say "I am pleased to confirm a decision has been made and you should receive a letter soon to confirm the decision"
1 day later she gets a phone call from the home office to say she applied too early and they offered her 2 options, to proceed with application at 10 year route as to which they will allow the early application, or they can hold the application until its within 28 days and process it from there instead. She said she wants to go for ILR and they said this is fine they will hold until then and she doesnt need to do anything else. They did say a letter was on its way to her which is automatically generated and to just ignore it as application is on hold for now.
She applied thinking she met her guidelines as 60 months had passed from November 2013 when she entered the UK but the guy on the phone said it has to be 60 months on the spouse VISA.
This has obviously concerned us and were wondering despite them saying they will hold this and come back to it is it likely they will still refuse VISA as we applied too early? We have to wait another 3 weeks before they look at it and I have a feeling its going to be the longest 3 weeks ever
