Non-applying dependants Question for form FLR(M)

Post by chrsrlstn » Thu Mar 07, 2019 2:04 pm

Good afternoon all.

I am also a little confused here. I am a UK Citizen and have lives here all my life and my wife is from Indonesia.
My wife was granted a Spouse Visa in Oct 2016. We are now applying for ILR extension. My wife has a daughter who is 28 and has no intention of coming to the UK. I have a 10 year old daughter from my previous relationship who is British Citizen as is her Mother. Maybe I am a little slow here, but I am confused how to answer when it asks if I have 'any other children in the UK that are not applying on this application.'
My daughter doesn't live with me and my ex and I do not speak. If I select 'Yes' it asks for Both Certificates and utility Bills, etc....... which are impossible for me to obtain.
My question is, do I select 'No" as she is a UK citizen??
I would be very grateful for any advice that you can give me. We only have a 28 day window to submit the completed ILR form!!

It is your wife's application you are describing here, so in this context your daughter doesn't come into it. So NO appears to be the right choice.
This is just my opinion as a member of this forum and does not constitute immigration advice.

What form exactly are you completing?? If she got the first spouse visa in 2016, she does not qualify for ILR (indefinite leave to remain/PR).

Hi guys,

Thank you so much for replying so fast! I will give you a little background information.....

We applied for a fiancé visa in Indonesia in February 2016, which was granted it within 2 weeks. We flew back to the UK and were married on the 18th June. We then applied for the Spouse Visa using the ILR (M) form on the 18th July and was granted a 30 month leave to remain on the Five Year Partner Route in Sept 2016.

We are now applying for an extension the the Spouse Visa via the online application. I assumed we used the same ILR (M) form as we did previously? I did notice when checking through the form that is states "Family Route', so maybe we have accidentally selected the wrong application form??

I am very grateful for all your help!

It is FLR(M) not ILR(M), hence why I asked the question.

5 year partner route is the one, second FLR(M) application.

I am so sorry for the confusion caused.

With regards to my original question, I have selected NO to non-applying children, but I have given detailed information that I am supporting my daughter with maintenance payments agreed between my ex and I, without the need of the Child Maintenance Service. I assume this is adequate?

One last question before I leave you in peace. Probably a very silly question now, but "Is this the first time you have applied for a partner route, or an extension, with your current partner (including as a fiancé(e) or proposed civil partner)?" Would I be right to assume the answer to be No as we have applied for fianćee and spouse visas before ??

Thank you for your time and patience. I am extremely thankful to you.

Many thanks.
