Swap Tier 2 ICT Primary to Tier 2 ICT dependent

Hi All,

I am working on Tier 2 ICT Main applicant in UK since Jan 2018. My wife (also employed with the same company as me) is working in UK on Tier 2 ICT dependent.

Now my wife wants to move from Tier 2 ICT dependent to Tier 2 ICT Main (for the same employer). I want to do vice versa i.e. move from Tier 2 ICT main to Tier 2 ICT dependent.

Questions

1. Can this swap be done while we are in UK , or do we need to travel back?
2. Is there a cooling period required for this to happen?
3. My son is on my dependent and will also move to my wife's dependent visa. Will there be any issue with this?

1. Your spouse cannot switch to ICT main visa holder within the UK. I am not sure if your spouse can apply for an ICT visa though if she has not worked the last 12 months for the sponsor in her home country. Why not Tier 2 General??

You can switch to PBS dependent within the UK once your spouse has returned.
