5 Year Spouse Route - ILR - Financial Requirement

Hello everyone,

Apologies if I'm posting this in the wrong place, but only just registered.

My husband is due to apply for ILR application after completing 5 years on a spouse visa. I would normally meet the financial requirement alone (£34,400), however I have been on a period of maternity leave and unpaid leave over the last 2 years. Only just returned to work last week, so will only have 1 payslip by the time he applies.

We could use his income to meet the threshold but I have some questions. He is on £20,000 since April 2017 and has payslips and corresponding bank statements. Since January, he has a second job and earning £20,000 from there also.

The issue is that in addition to his salary, he has irregular payments for expenses, equipment for the job, some loans from friends and some are just gifts. Will we have to explain every single payment in addition to his salary or will HO just oversee it because he meets the threshold?

HO is only interested in his salary if it meets the requirements.

Really?! Just to clarify, the irregular payments are from the same company he works for?

payslips and bank statement need to match in terms of Salary paid weekly or monthly.

You can write a brief covering letter if you wish on the other.

Can I also ask, would it be possible to use my income from before I went on Maternity Leave which was in March 2017. I was paid up until July 2018 and then unpaid until 2 weeks ago.

Hello everyone,

I need some clarification on the category I should apply under to meet the financial threshold please.

My husband (the applicant) has been earning a gross salary of £16,000 since April 2017 until January 2019.
In January his salary increased to £20,000.
In February he got a second job earning £20,000 also.
We will apply as soon as his March payslips come through so will use payslips between April 2018 - March 2019.

Am I right in using Category B to apply?

Calculation:
£1333 x 9 months = £11,997
£1666 x 3 months = £4,998

= £16,995 from 1st Job

£1666 x 2 months = £3,332

= £3,332 from 2nd job

£20,327 - Total gross income in the last 12 months

I will also include all my non-salaried income over the last 12 months whilst earning maternity pay, just to be on the safe side.

Does this all sound correct to you?
