Hi,

so I am applying for spouse visa, currently i am on T5, so i am applying within UK

my husband has been working since May 2018, his first job after graduation, hourly rate, so his monthly salary is not the same, but over 18.6 already when you just look at his payslips

but then

1) his company can't even provide him a working contract even my husband requests

2) for the employer letter, his company has written , average annual salary as 25k, since
he sometimes works much longer than the "agreed" 7 hours per day
*** he has now earned over 18.6 k already, we at first planned to combine income, mine is 16950

3)he hasn't worked for 12 months, but then when we filled in the form online for the visa application, the systems requests Payslips covering any period of salaried employment (current and previous) in the period of 12 months prior to the date of application.

I am just wondering

a) should he still use that letter for application ?

b) should we include my income , payslips and banking statement in the "additional income for maintenance' ?

c) should we just include his payslips from May 2018 - Mar 2019 and apply ?

3. If he has been working from may 2018 then he should apply under category A where he only needs to provide 6 months of payslips & bank statements. If system is asking 12 months then perhaps some question has been incorrectly answered.

I have selected " not the same amount of salary continuously but above the financial requirement' , i think this is the main reason why 12 months are required.

But then he only has 10 months......will this be a problems ?

I am planning to explain his average salary too for additional info, gonna calculate the gross with the formula, since we cant actually get the average 25k stated by his company . That should be lower but still over 18600

If the monthly wages vary each month then preferably the employer should write the average income in the letter or the basic annual wages plus overtime.
