TIER 1 ILR

Hello,

I am about to hire an employee who is British by birth but he does not have a passport as he has never travelled abroad. He has the birth certificate but as the requirement in the guidelines say;

" if the employee was born in the UK on or after 1 January 1983, a birth certificate, together with documentation, such as a passport or naturalisation certificate, which
confirms one of their parents had settled status in the UK when the employee was
born"

He does not have a passport nor a naturalisation certificate, just got his birth certificate and NI card along with driving license. Can you please help me out by letting me know what other document should I need to prove that his parents had settled status in the UK when he was born? All your responses will be highly appreciated.

Hi

You need to get a copy of his parents ID means their passport or birth certificates and also send request to HO for the status of employee checking service.

He lives with his mom and is willing to give her birth certificate but can't provide his father's because he has moved to another EU country. Can you please guide me how to contact HO for the status of employee checking service.

One more question, he has applied for his first passport now and will receive it in a couple of weeks. I have hired him already so will it be ok to give passport as his evidence of being British while applying for ILR then?

Hello,

I was filling the online SET (O) form for my dependants and need help with this question

When did you first enter the UK? (Required)
This is the date you entered the UK when the period of stay you are basing this application on started.

The thing is my family was already in UK since 2012 as spouse had TIER 4 student visa. Only I entered UK after approval of TIER 1. So I am confused now which date shall I enter then. Please guide me

It is not important what date you put in. You can put actual date of entry or date or you switched visa.

Now I have got the accounts and tax return of 1st August 2017 -31st July 2018 but I do not have the accounts of 1st August 2018 to 31st July 2019 as my accounting period ends on July
31st. Do I need the Management accounts from 1st August 2018 to 30th April 2019? But what about the Tax return CT600 as I will not be having it as well? Please advise.

Accounts are not needed for ILR. You have to submit CT600 but there is no guidance that it should be the latest one. You can submit the previous year CT600 in that case. CT600 has to be submitted just to prove that your company is registered for corporation tax. You can submit either CT41G or CT603 or CT600. But its best to submit two of them if you have.

You don’t need your business account for ILR, the year 2017 will definitely show in the companies house filling history and that definitely is sufficient since the current year is not due. If your account ends 31st July, then your 2018/2019 account will be due next April 2020. So don’t worry at all.

One more question,

I have read in one of the posts that

"The English language test must have been taken no more than 2 years before the
date of application. However, tests that have been taken more than 2 years ago and
have since expired, can still be accepted where the qualification:
• is from one of the providers on the current SELT list
• has previously been accepted by us as part of another immigration application,
such as for entry clearance. A qualification that is not from one of the providers
on the current SELT list, is not acceptable even if previously accepted by us as
part of another application"

I am really confused here and must be understanding it wrongly but please guide me as this is really important.

I gave IELTS General Training in Aug 2013 from London Crest Open Centre, Edgeware, HA8 7BJ which I got points for my Initial grant of Tier 1 and also for my extension. I am unable to find and understand in the current SELT list if this will be accepted or not. The centre stamp is of London Crest Open Centre, Edgeware, HA8 7BJ whereas validation stamp is of IELTS Cambridge Esol, British Council, IDPLA. Can anyone please have a look and guide me if it will still be accepted for ILR as I can't decide by reading the list.

Do I need to sit for another IELTS test and if yes, then which one?
IELTS General Training (as I am applying for ILR under Tier 1 (entrepreneur) or
IELTS Life Skills B1

If IELTS is on the SELT list as an approved provider, then it should be accepted, so check the list. It does not matter if it has expired, what matter is whether it’s in the list.

My spouse (applying with me for ILR) has Masters degree from UK University. To get points for English language, does she has to sumbit NARIC certificate or just the degree will be enough

There are no 'points' for PBS Dependents. They simply have to meet the English requirement and LIUK.

With a UK Masters, she doesn’t need NARICS, she can use that to claim point

Yeah sorry, she just have to present the proofs of both English language competence at level B1 of CEFR and LIUK pass certificate
