Tier 1 Talent ILR

I have two questions about ILR. I have a Tier 1 Exceptional Talent.

- for earnings in the field of expertise, do I need to be employed at the time of application or is it sufficient to show proof of past earnings? I'm trying to decide if I can leave my current job before applying or if I must force myself to stay until the application.

- I have been in the UK for four years total , under T2 General for 2 years and T1 Talent for 2 more. Can you please confirm that fullfills the length of stay required?

You better stay there until you get your ILR sorted. It is required. Also you need 5 unbroken years but this depends on your timeline and visa dates.

I believe for T1 the requirement is 3 years not 5?

You can take the 3 years route if you have employed 10 settled workers or you have a turnover of not less than 5 million pounds

The user is NOT on Tier 1 Entrepreneur but on Tier 1 Exceptional Talent!!! The above is NOT relevant to their visa category!!

Thanks :) I'm still confused about the earnings, the gov website appears to be indicating that you must be employed at the time of applying, but the Policy Guidance for T1 pdf seems to say that only proof of earnings in the field are needed. Can you please help clarify?

I got advice from a immigration barister that there is no need to be employed at time of applying, the requirement is only proof of past employment in the field of expertise. The wording in the application form is a bit unclear on this point.
