Travel restriction on PBS Dependents of Tier2 -> ILR

Post by Confused36 » Fri Mar 29, 2019 10:04 am

Hi All,
I was on Tier2 General previously and have now got ILR on 5 years full employment basis. My dependents are still on previous Leave to Remain as PBS dependents and will be applying for their ILR in May.

Issue: we have to fly out of country tomorrow. Someone now told me that my family will be stopped at immigration on return and will be questioned about why they had not been moved on to my ILR status.

Question: Would this really be the case? I had an impression that as long as their current leave (March 2020) is valid there is no need to change their status and they are also fine to travel in and out of UK.

Can someone please confirm?

Regards,
Confused!

They are free to travel as long as they have a valid visa. Their visas remain valid, there is NO requirement to switch visa categories simply because you got ILR based on 5 years Tier 2.

There is no issue.
