PBS depenant ILR where 189 days were spent outside UK

Post by yawar » Wed Mar 27, 2019 7:08 pm

Hi,
I got my ILR based on T1 Entrepreneur 5 year route from 2013 to 2018. My wife (T1 PBS dependent) had an entry in Sep 2013. She stayed 189 days (over 180 days) between Feb 2014 to Feb 2015. I got her extension last year thinking that because she stayed 189 days abroad in one year hence will not be eligible for ILR after 5 years. She will be eligible for ILR in May 2019. I was just filling in the form online and was surprised to see that i was only asked the travel history after 11th of Jan 2018. This got me thinking that wether over 180 days rule apply to PBS dependent or not.
So simple question is that can i apply for her ILR now? Her date of entry in UK was 13th of Sep 2013 and she stayed 189 days abroad between Feb 2014 to Feb 2015.

Not relevant to any time spent on PBS dependent visas issued before 11th January 2018.

She could have applied last year already. The absence in 2014/15 is irrelevant.

There is a question " Have you had any absences from the UK during any leave granted since 11 January 2018?"
After 11 Jan 2018 she only had one extension on 14th of Nov 2018 for another 3 years. I wish i had know that she could apply for ILR then. Anyway so do i have to enter travel dates after 14th of Nov 2018 or i have to provide all travel details after 11th of Jan 2018?

If she has a visa extension after 11th January 2018, then YES, you have to list the absence that occurred after her visa extension issue date.

verification checks consent form

Post by yawar » Fri Mar 29, 2019 12:44 pm

Hi,
My wife is going to apply for ILR as PBS dependent. There is a form which is "verification checks consent form". Note says the following
"You must download a copy of the third party verification checks consent form. You must sign and include this form when you provide your documents"
There are three pages; I just want to confirm if my wife signs page one and i sign page three. Is it correct?
Following is the link of that consent form.
