Can PBS dependent apply for ILR after 5 years

Can PBS dependent apply for ILR after 5 years

Hi ,

i got ILR on long residency (10 years) last year. now i am applying for British Nationality. before that i was on Tier 1 entrepreneur. i have wife on PBS dependent since feb 2014 ,got extension on 2017 living with me in uk. two of my kids born in uk are British now.

She is with me in uk for last 9 years as dependent first Tier 4 (4 years ) , then Tier 1 PBS (5 years)

can we apply for ILR for my wife as she had spent more than 5 years on PBS dependent which is expiring on august 2019 ?

No she cannot as you did not obtained ILR through the PBS route.

You were already advised of this in May last year when you asked.

1. Is there any other way instead of FLR or FLRM ?

2. She is living in uk for last 9 years as my dependent. Fee are very high and also increased health charges as
well. will we get health charges back as next year she will be going for ILR on 10 years if no other option ?

1. She is not able to extend her current visa as a PBS Dependent. She can only apply for FLR(M) for FLR(FP) which both cost the same. She cannot apply for ILR based on PBS Dependent, it will be refused. The rules regarding PBS dependents of ILR LR applicants changed in 2014, so nothing new or recent.

2. You are unlikely to get the IHS fees back.

You will not get a refund if:

your visa application is successful but you do not come to the UK
you leave the UK before your visa ends, for example to make a new application
you’re told to leave the UK before your visa expires
you’re applying for indefinite leave to remain or changing to another visa where you do not need to pay the IHS
