ILR eligibility for Spouse

ILR eligibility check for dependant

Hi,

First I would like to appreciate this great website.

I came to UK on June 30 2010 on Tier 2 ICT.
I married and brought my wife on Tier 2 ICT dependant visa to UK on April 2013.

I switched to Tier - General on 30th March 2014. My wife went to India on Maternity leave from January 2014 to March 2015.
I have applied for Tier 2 General Dependant visa for my wife on March 2015.

My visa and my wife visa will be expiring on May 2018 so would like apply for ILR before that.

I know that i am eligible for ILR. I have two questions/clarification here

Is my wife eligible for ILR. based on the below two points?

1)5 Year eligibility:
She entered UK on April 2013 and from that date she is on PBS dependant visa (Tier2 ICT & Tier 2 general) till today which is more than 5 years.

Please comment on above.

2)Continuous Period :
My wife is absent January 2014 to March 2015 which is more than 1 year but this absent taken with rules in place before 1st Jan 2018 continuous period change
so I think continuous period of 180 days check only applicable for new/extension done after Jan 1 2018.
My wife is not absent for more than 180 days after 1st Jan 2018 so based on this my wife is eligible on continuous period check.
Please comment on above.

if my wife is not eligible may i know when she will be and on what visa i need to extend her so that she will be eligible for ILR ?

She should be eligible for ILR as she spent the 5 years under PBS dependant (given you are eligible for ILR)

I was married and brought my wife on Tier 2 ICT dependant visa to UK on April 2013.

My wife went to india on Materinity leave from January 2014 to March 2015(more than 1 year). At this time she was on Tier 2 ICT dependant visa.

On 30th March 2014 I switched to Tier 2- General.

I have applied for Tier 2 General Dependant visa for my wife on March 2015 and my wife is on Tier 2 general to till today.

I have doubt on my wife's ILR eligibility based on below doubts
