10 Years ILR application

Hello,

I have just received my Tier 1 Entrepreneur 50K extension visa which is valid until March 2021. I have been legally in this country since 08/2009 which means I am due for ILR in 07/2019. I would like to get some clarifications on below:

1. I have some plans already in place for this year and won't be able to make an application for ILR very soon. So can I delay it until Dec 2019 rather than applying in Jul 2019? Will it affect my application?

2. Do I need to make any minimum earnings to be eligible for ILR?

3. Do I need to show maintain any balance for ILR?

4. My wife is on dependent visa which will expire in March 2021. Her first entry in UK was in July 2015. Do I have to change her visa or she can continue as a dependent even though my visa will change from Tier 1 to ILR? If I have to, when will she be eligible for ILR.

1. You can apply at any time once you meet the requirements. There is no rule that you must apply immediately when the requirement is met.

2. No.

3. No.

4. Yes, you have to change her visa to FLR(M), which will reset her clock for ILR to zero and a new 5 year route (2 x 2.5 year visas) before she can apply for ILR. She won't qualify to apply for ILR as a Tier 1 Dependent if you apply for ILR based on long residence. She will need to meet the English and financial requirement for FLR(M).

Thanks for your reply. So if I apply for ILR based on 5 years of Tier 1, when will she be eligible for ILR?
