tier2 dependent to settled dependent switch

Post by MrsJ » Sun Sep 16, 2018 2:06 pm

Hi,
I am currently as tier2 dependent and my husband will be eligible for ilr coming january but the vailidity of my visa is until september of next year. I will be in country as tier2 dependent for 4 years , when my husband applies for his ilr. My question is
1) do i need to switch to settled dependent visa soon after my husband gets ilr or i can continue in same currently issued tier2 dependent visa ?
3) after i switch to settled dependent visa , does the continuous stay of 5 years as dependent continue from my previous tier2 visa or the new settled dependent visa ?

I would really appreciate if i could get an answer on this :)
Thanks,

On what basis is your husband applying for ILR, 5 years Tier 2 or 10 years long residence??

The answer to the above determines what route you have to follow.

1. No. Better to continue and extend under 319C shortly before leave expires.
2. If you choose to switch, then qualifying period for ILR may reset.

Thanks for your answer.
What is the term for visa or form to apply under 319c ?
Will that be just an extension before she can apply for settlement or is that settlement visa itself.
Please let me know :)
Thanks,

It is the tier 2 dependent online application.

https://www.gov.uk/tier-2-general/family-members

It is a 3 year extension as tier 2 dependent and is not "settlement" or ILR.

You need 5 years residence as tier 2 dependent before you can apply for ILR. If your visa is valid till September next year, you only need to extend next year before expiry.

Oh ok...may be i missed to inform that..when i apply for extension my husband would have got ilr so tier2 dependent application wont be vaild as it cannot be extended beyond 6 year ?
Are you saying i can extend it under tier2 dependent even when he has already got an ilr ?

Sorry if its sounds confusing :)

The is NO limit on how long you can hold a tier 2 dependent visa.

The 6 year limit is ONLY for the main tier 2 visa holder!!

The rules allow tier 2 dependents to extend their visa when the main applicant gets ILR based on tier 2, see the link with the rules below.

Traveling on pbs dependent visa when husband has ilr

Post by MrsJ » Thu Apr 11, 2019 8:52 am

Hi,
my husband got ilr this January, and i am still on the dependent visa(tier2 dependent) until upcoming end of September.
I had few questions, regarding my situation.
1) can i travel in and out of the country in the same visa as long as the visa is valid or do i need to extend my pbs dependent visa to travel ?

2) i am planning to apply for visitor visa for my parents, main sponser would be my husband. Can i still invite them, as i have 6 months visa left and my husband has ilr. Are there any problems with that ?

Thanks,

1. You are free to travel as long as you return before your visa expires.

2. Please ask your visitor visa questions in the General Immigration (click) sub forum as these questions are not relevant to Tier 2 or Family Immigration sub forums.
