Spouse visa urgent

Hi, I am applying spouse visa UK from India with one dependant child .my child born in UK and for some misunderstanding my husband ILR got refused .along with that my flr(m) visa got refused .he applied for appeals,judicial review, and won the case .solicitor did not included my name in the appeals.so I overstayed for 1 year because my child is born in UK she is not having travel document ,passport .
To apply travel document parents original passports are required .our passports are with homeoffice .we chased the home office to send attested copies of passport so that we can apply for travel document.
Me and my child travelled to our hometown.
Now I am applying spouse visa UK with one dependent child to join my partner .do home office allow entryclearance to UK.
