Query regarding past earnings

Post by jhp » Wed Jun 11, 2008 8:17 pm

I plan to apply for Tier 1 (Gen) initial entry. I have a query regarding the evidence for past earnings. I plan to send

1) 12 months payslips from April 2007 to March 2008
2) P60 for the same period

Now I am not entirely sure if this acceptable since technically both are from the same source. Please can anybody let me know if they have applied with P60 and payslips and succeeded.

Many Thanks

I would not agree with that. Although, just like the salary slips, even the P-60 is prepared by the employer (as in the same source) it is a credible "distinct" proof in that it is an official representation of the company to the tax authorities - unlike a letter that my be issued by the employer to be used by the employee.

At the same time the documents (salary slips and the P-60) indeed are from the same source and this is in contravention to the following guidance availableon the website:

"The two types of evidence provided must be from separate sources, for example, when sending documentation showing salaried employment, payslips should not be provided in combination with an employer letter, as these documents are both considered to be from the same source. The separate documents provided must be consistent with, and corroborate one another about, the earnings that you are claiming."

It will be good to hear from someone who has succeded using these 2 sources under Tier-1.

If you look at the BIA website and read through para 110 point 4 of the Tier 1 policy guidance, you will note that P60 is considered as a valid "tax document" even though it is generated by the employer.

P60 is a document created for the purposes of an official return to a tax authority, and AFAIK, in UK if your taxable income is only from salary then you need not file a tax return until the HMRC specifically asks you to do so. For the purpose of Tier 1 therefore, P60 and pay slips are valid independent evidences.

Though a bit unrelated, but I can confirm that in 2006 my partner applied for HSMP approval and subsequent FLR on basis of payslips and P60 only.

I agree, but the confusion here seems to be regarding both the evidence being from the same source. Seems like a grey area to me.

Has anyone got approval under Tier-1 using these two dox??
