Tier 2 dependant extension- main applicant got ILR recently

Dear all,

May I please request you to help resolve some of my queries regarding my wife’s application.

Main Applicant:
Currently hold Indefinite Leave to Remain (ILR) since February 2019 ( After Tier 2 General visa- 5 year route)

Partner :
Entered in the UK in June 2015( Tier 2 General dependant)

Extended Tier 2 General dependant visa in Dec 2017- Vaild Upto May 2019

My wife would need to extend her visa (She qualify for ILR in June 2020 as she complete 5 years on Tier 2 general dependant visa)


My queries are,

1. She need to pay Immigration health surcharge (IHS) - my ILR is valid until 2024 - when we enter it on IHS form that make IHS fee enormous!!
Any guidance on this is highly appreciated.

2. Can she apply for extension for 2 years? if 2 years extension is possible how to do it on application form?
(Or it has to be upto 3 years)-
To avoid the additional cost it incur as we would definitely apply for her ILR once she qualify next year.


Kindly advice us with these two scenario please.

Put your ILR expiry date as 3 years from now (2022) to get the correct amount of £1200. A Glitch in the system HO is aware of by the way.

No.
(Or it has to be upto 3 years)-
The immigration rules state it will be a 3 year extension. It is not possible for the applicant to choose a lesser time.
To avoid the additional cost it incur as we would definitely apply for her ILR once she qualify next year.
This is irrelevant. Your spouse will get a 3 year extension as stated in the immigration rules.
