Guidance requested from Senior Members please

Post by sfcm80 » Tue Apr 09, 2019 7:20 pm

Hi,

I need assistance from senior members of this forum i.e. Casa, CR001, Noajthan, Geriatrix. I recently received my FLR-FP visa approved on 10 Year Partner Route. UKVI issued me 2.5 years visa. I have lived in this country 8.5 years so far til April 2019. I like to apply for ILR after i complete 10 Years lawful residence. But UKVI mentioned in the decision letter that i have to complete at least 10 years under this category of 10 Year Partner route FLR-FP? Can i still apply for ILR after i complete 10 years Lawful residence after adding 1.5 years from my current 2.5 Year Leave to remain?

My history is as under:

- Came to UK on 23 Aug, 2010 as PSW (Post Study Work)Dependant of my Husband.
- I applied for Tier-1 (General) PBS Dependant Visa with my Husband in March 2011 & Visa Approved in June
2011 (2 Year Visa).
- I applied as PBS Dependant extension under Tier-1 (General) with my husband in June 2013 and Visa Approved in July 2013 (3 Year Visa).
- I applied for ILR as SET(O) Dependant with my Husband in June 2016 on the basis of Husband completed 5 Year under Tier-1 (General) SET(O)
- My husband varied his ILR-SET(O) application to ILR-LR on the basis of 10 Year Lawful residence in March 2017 so i also had to vary my ILR-SET(O) Dependant application to FLR-FP.
-My Husband ILR was approved in Oct 2017 but my FLR-FP was pending until March 2019.
- Uptil March 2019, My husband and my 3 children (Born in the UK) all became British Citizen and have now British Passports.
- In March 2019, UKVI called me for an Interview over Skype as i had TOEIC in my immigration history.
- I attended this interview and it was fully about my TOEIC Genuineness.
-After the interview, UKVI was convinced that my TOEIC was genuine and they issued my 2.5 Year Leave to remain under 10 Year Partner Route of FLR-FP.

My questions are:

Q1:- Can i apply for ILR after i complete 10 Year of Lawful residence? I have spent 8.5 years in UK So far and i just have to add 1.5 year to that from my current 2.5 year Leave.

Q2:- Can my Husband Claim Child Benefit and Child Tax Credit for our children?

Q-3:- Will these Child Benefits claimed by my Husband affect my ILR or further extensions in the future?

Q-4:- If i carry on extending Visa under my current 10 Year Partner Route of FLR-FP, do i have to meet income requirement of £18,600 and the English Language requirements?

Q-5:- What level of English Language Test is required for Extension under my current category?

Sorry for the Long post. Please advise me regarding the questions.

Kind regards,

SFCM80

You’ve probably reduced your chances of advice as anyone other than above won’t want to reply.

Exactly. Members should also bear in mind that Moderators (including myself) don't necessarily have more knowledge than other contributors on the forum.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
