How is a residency period defined?

Post by MostlyUk » Wed Apr 17, 2019 2:41 pm

A 60 years old acquaintance of mine holds a US passport, was educated and has resided and worked in the UK for most of his life except for a three year period when he lived and worked in the US. He has a National Insurance number and is in current employment but his US passport gives no indication of a right to work in the UK. What should be do? Is there a risk of him being deported under the present climate, despite his years in the UK?

Surely he knows on what immigration basis he has lived in the UK??

What are his parents nationalities and immigration history etc?

What do his expired passport say, anything like a sticker saying Indefinite Leave to Remain?

Thank you for your reply. He seems to have got himself into a state of panic. His previous passports showed indefinite leave to remain but not his current one. He is anxious because he lived and worked in the US between 1988 and 1991 and thinks this will work against him. It was his employer who raised the matter of his residency with him. My acquaintance late father held a US passport but his mother holds a UK one and was born in England. He is having difficulty locating old pay slips but we have advised him to contact the inland revenue for evidence of tax payments and his GP for records of medical treatment.

Why has he not registered as British on form UKM, costs £80.

He also will have to apply for a Biometric Residence Permit to transfer his ILR in his passport to a card.
