Hi everyone,
I'm a US Citizen with a UK partner, we've been together for well over two years and can prove it, we are now just trying to close the gap. I am currently in England under a short term student visa which will end in July. I would like to know if I can switch my student visa into a civil partnership visa. I do plan to immigrate to the UK later but I still need to finish my studies in the US for 1.5 years. Is this possible or should we go down the spousal visa?

I would be inclined to go for a spousal visa because I got an unmarried partner visa, and I had to declare that my partner and I intend to live permanently in the UK.
If you have to be in the US for 1.5 years, it seems like becoming a spouse will make it easier for you guys when it comes to visa applications.

When you cannot get a family visa
In some circumstances you cannot apply for, or switch to, a family visa.
Your family member has a work visa or student visa
You cannot apply for a family visa if your family member is in the UK temporarily on a work visa or student visa.
You can apply to stay with them as a dependant instead.
You have a visitor visa or a visa for 6 months or less
You’ll usually need to leave the UK to apply for a family visa if either:
•you have permission to be in the UK as a visitor
•your visa is for 6 months or less
However, you might be able to switch to a family visa in the UK if you have either:
•a 6-month family visa as a fiancé, fiancée or proposed civil partner
•permission to stay in the UK for the outcome of a family court case or divorce

Hi everyone,
Thank you for your response. The spousal visa does seem the best way. So my partner looked into how much they make per annum and it is just shy of the 18,600. What can we do in this case? And could someone be kind enough to list what proofs are best to send?

What is the validity of your short term visa, start and end dates??

My short term student visa started on 02/01/19 and it expires 02/07/19.
I know it is almost up, frankly we didn't start thinking about immigration till recently and that was our mistake.
