Tier 2 General Visa - Cooling off period and time rest for ILR

Post by hms001 » Sun Apr 21, 2019 1:38 pm

Hi Gurus,
I was employed in the UK from Feb 2016 till I resigned in July 2018. I have since not been back in the UK on any form of visa.

I understand the cooling period will apply but will it apply from 60 days from July 2018 or Feb 2019 (when my BRP was due to expire)?

Also, in the event that me precious employer wants to re-hire and provide me with sponsorship (assuming after the cooling off period as the salary doesn't meet the benchmark for waiver), will it reset the ILR clock to zero i.e. I'll have to do the full 5 years again?

1. Cooling off period starts from the date you Left the UK and you will likely have to provide evidence of this, ie boarding pass.

2. Yes, you will need a new 5 year period before you can apply for ILR.
