ILR for Tier 1 General Dependent

Please advise if number of days out of the UK required to be counted? for spouses to apply ILR (under 5 years scheme) whose partner is a settled British Citizen. Suggestions awaited.

If your spouse is a Tier 1 General dependent visa, ONLY absence for visas issued on or after 11th January 2018 are counted. Absences before this date are NOT counted.

Your ILR or Citizenship status is completely irrelevant.

Presumably though, you got ILR based on Tier 1 General and not 10 years long residence??

My wife has got the Tier 1 dependent General visa extension in Dec 2017 for three years (i.e. until Deb 2020). This has been in continuation to her entry clearance which she has got in Feb 2015 but actually arrived UK in April 2015 (completing five years in April 2020).

Although she has got her visa before 11th Jan 2018. Any travel absences after 11th Jan 2018 would be counted. Please advise.

Feb 2015 but actually arrived UK in April 2015 (completing five years in April 2020).
Her residence starts counting from the date of her initial visa stamping in Feb 2015.
Although she has got her visa before 11th Jan 2018. Any travel absences after 11th Jan 2018 would be counted.
No it does not. ONLY absences for visas issued on or after 11th January 2018 are counted.
