tier 1 dependent 6 months short for ilr

Post by wasana » Mon Feb 04, 2019 8:41 pm

Hello there
my wife came to uk as tier 1 general dependent on jan 2015. I was on my second half of tier 1.
then i got ilr on apr 2016 and my wife had to extend pbs dependent as she needs to stay 5 years with me to apply for ilr. she got PBS dependent leave to remain untill may 2019. but still she need another 7 months to complete 5 years. (jan 2020)

1. can she apply for pbs dependent extension only for 7 months?

2. or is there another way to achive this short time period?

i will appriciate your quick response

Thanks

If she will qualify for ILR in Jan 2020 then instead 7 months she will still need around 11-12 months. I think she can apply tier 1 dependants extension which according to other members will be for 3 years and the IHS of around £1200 will be needed to pay along with application fee. Unfortunately you can't choose the length of visa lesser than standard 3 years.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Hi seagul

Can you please let me know what you think about bellow point.

Skilled Workers and Students (Dependants) - Policy Guidance (03/2019)

45. Partners: We will grant leave in line with the expiry date of the Main Applicant’s leave, except where the Main Applicant has been granted indefinite leave to remain. In these cases, we will grant you a period of three years leave. An application for further leave may then be made if required to take you up to the applicable qualifying period for indefinite leave to remain.

thanks

What exactly do you want to know about the quoted piece??

She can apply for a 3 year extension. She cannot apply for less visa validity.
