SET(M) OR SET(O)

Post by neetaupadhye » Tue Apr 30, 2019 1:45 pm

Hello
I am planning to apply ILR in the coming weeks. I have completed 5 years
I have life in uk and English language also Done

However i am not sure whether i should be using the Set(O) form or the Set (M) form.

I am currently holds the leave to remain as a Tier 1 dependent (PBS dependent) which means that i should be filling in the Set(O) form online.
However my husband obtained British Citizenship in 2017 and as such i am now would be classified as the spouse of a British Citizen which means i should be filling in the Set(M) form online.

As such I am not sure which form she should be filling. When you get a moment please let me know your inputs on which form is the correct form.

It is based on the VISA you hold, NOT your husband ILR or citizenship.

You only have the option of Set(O) if you hold a Tier 1 dependent visa.

If you apply on Set M, it will be refused as you do NOT have 5 years of holding a Spouse Settlement Visa.
