Just a few queries...(should be simple?)

Post by DartmoorWitch » Sat Apr 27, 2019 12:16 pm

 here we go, the two and a half year extension coming up! Hope these won't be too difficult to answer. All of this relates to the online form:

- General question: "If you're extending to stay with the same family member, you will only get up to 28 days left on your current stay added to your visa" - just want some clarity on this statement? My partners visa expires on the 30-06-2019, so when is the best time for her to apply? 28 days before her visa expires?(because we want to make sure we have enough for 5 years before she apply ILR in 2 and half years later),Sounds silly to ask but we want to double check, and to clarify the application time mean when we submit the online form or when we finally go for the appointment to do the fingerprints and photos.

- On the second part of the form ("Applications") the question relating to "Time lived in the UK" - should we include the time my partner spent in the UK on her fiancee visa in addition to her (near) completed 2.5 years?

- we are confused as to whether or not she was ever required to register with the police? I don't she was, as it only applies to certain nations. My wife is a Chinese national. This question is again in the "applications" section.

- we want to double check this (again in applications): Question "Is this the first time you have applied for a partner route or an extension with your current partner (including as a fiancee or proposed civil partner)" - we believe this should be "no" because my wife came here on a fiancee visa then we got her 2.5 year visa after we married? Are we correct?

- Following on from that, the question "Please choose a reason you are applying for an extension (this includes if you are switching from a partner visa to another type)" - we THINK it should be "additional extension as a partner" - but in light of the q immediately above this one we wanted to double-check.

- Question: "Please list your shared financial responsibilities" - should we list stuff like food bills, general utilities+non-essential utilities like the internet?

- Question: "Where have you lived together" - they only allow for one address in this part of the form, although we have lived in two different locations since she came to the UK (including our current address) - I'm guessing this is OK because they allow you to put more addresses in later?

Questions from the finance section:

- My partner is on a zero-hours contract at the moment. Her hours vary from 0-14 per week. They're asking for the net pay but we're not sure what to put down as it varies?

Final question (!) - in the "documents" section we're wondering if there's any additional documents we can provide on top of all these documents required? Last time we provided a couple of covering letters, photos, etc.

Thank you for your time :D

For meeting the financial requirement of £18600 only the gross income (before any deduction) matters instead net pay. But not sure that you can meet this requirement through only working 0-14 hours per week unless you combine that income with your income or other permissible sources like saving, rental income etc.

You maybe able to scan and upload covering letter again.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Apply no earlier than 28 days of current visa expiry. It’s best to apply as close to visa expiry as possible. You never know you may have important reasons to apply early for the 2nd FLR(M) extension and so any time gained now will help for them also.

- On the second part of the form ("Applications") the question relating to "Time lived in the UK" - should we include the time my partner spent in the UK on her fiancee visa in addition to her (near) completed 2.5 years? I think include the financee visa period if that was immediately prior to the existing visa ie a continuous period. If it is not a continuous, make reference to the fiancée visa separately.

- we are confused as to whether or not she was ever required to register with the police? I don't she was, as it only applies to certain nations. My wife is a Chinese national. This question is again in the "applications" section. She would know if she had to register with the police. I would suggest for most people the answer is No, however, she needs to ensure the answer is correct as you don’t want to be accused of telling a lie

- we want to double check this (again in applications): Question "Is this the first time you have applied for a partner route or an extension with your current partner (including as a fiancee or proposed civil partner)" - we believe this should be "no" because my wife came here on a fiancee visa then we got her 2.5 year visa after we married? - Following on from that, the question "Please choose a reason you are applying for an extension (this includes if you are switching from a partner visa to another type)" - we THINK it should be "additional extension as a partner" - but in light of the q immediately above this one we wanted to double-check. Possibly ‘First extension as a partner (following an initial period of entry as a partner, or as a fiancé(e) or proposed civil partner of a settled person)’

- Question: "Please list your shared financial responsibilities" - should we list stuff like food bills, general utilities+non-essential utilities like the internet? I answered ‘We have a joint bank account with XX which includes monthly payments for (1) Mortgage bank name £XX. (2) Virgin Media for TV, phone and broadband ~£XX. (3) Loan from XX £XX. (4) Mobile phone from XX ~£XX. I also have a bank account with XX from which (5) TV licence £XX. In addition to the above, our daily expenses for food, travel and shopping is paid for from both the joint XX and XX bank accounts‘

- Question: "Where have you lived together" - they only allow for one address in this part of the form, although we have lived in two different locations since she came to the UK (including our current address) - I'm guessing this is OK because they allow you to put more addresses in later? I entered current address here. Later on the form asks for any other addresses and you can detail the previous address and period there.

Questions from the finance section:

- My partner is on a zero-hours contract at the moment. Her hours vary from 0-14 per week. They're asking for the net pay but we're not sure what to put down as it varies? Not sure

Final question (!) - in the "documents" section we're wondering if there's any additional documents we can provide on top of all these documents required? Last time we provided a couple of covering letters, photos, etc. You can provide additional documents you wish, in fact do so, such as a covering letter and any other documents you believe are relevant. Do not include loads of unnecessary documents (such as photos) as that can cause Home Office to overlook the mandatory documents. The main evidence for proof you live together is the evidence of cohabitation ie 6 items in joint names, to cover the 2 years prior to visa application.

Thank you for your time :D

Thank you very much! (Also to our second poster, no worries as my financial situation is enough for us both). I think that clears up everything, and the ones you didn't know about seem OK anyway.

Also, she's a proud B1!

Take care.
