can overstayer apply for ILR ?

Post by ET in London » Mon Apr 29, 2019 4:47 pm

hi there,
Arrived in London on March 2006 on my tourist visa on 180 days permit to stay. but remained here til today. so total 13yrs 1month.
Is there any chance next year I apply for ILR, base on the '14yr rule' ?
thanks

There is no longer a '14yr rule for ILR for overstayers'. It was removed/discontinued in July 2012.

How have you supported yourself during your 13+ years of overstaying? Do you have family/children living here?

With no spouse or children, you only have the in country option of flr FP private life and there is no guarantee of success and these applications take a long to be processed. If you are successful, this is a 10 year route to ILR, 4 x 2.5 year visas.

Visa fee is £1033 plus Ihs of £1000.

HO will want to know if you have used NHS (and they check) and how you have maintained yourself while in the UK illegally.

You have to pay at each visa extension stage and for ILR etc. Visas fee increase every year and IHS has doubled in January from £200 per year to £400 per year.
