Tier 2 dependant visa extension. Please advice.

Post by dreamthreater » Thu May 02, 2019 6:01 pm

Hi,
I was under tier 2 category before. I got my ILR on last October last year. And I left my sponsor on feb this year.
The problem is my current employement is totally different from what I have declared with home offie during the time of ILR application. There has been a considerable drop on my salary.

I need to extend my wife's visa this month and I am afraid that home office might question the issue.
My question is, can we prepare application without my employment information?
or, what's the possibility of home office questioning about the drop on my salary?

Please give me some advice on these. I am in really big confusion.

Your employer is irrelevant for a tier 2 dependent extsnsion. Your dependent is dependent on you, not your previous sponsor.

There is also no minimum salary requirement for a tier 2 dependent visa.

You need to have 90 days maintenance fund of £630 per dependent.

Presumably you got ILR based on tier 2 General and not 10 years long residence??

Thanks for responding. I received my ILR based on Tier 2. We submitted the documents declaring, the sponsor needs me in future and my salary was meeting the threshold to obtain a settlement.
But now the home office will think I was cheating them if they see my current salary.
I am too scared, if they think I obtained my ILR cheating them, will they revoke it?

After ILR you are free from restrictions that were on your tier 2 visa e.g you are free to work any where and any job, being an employee or self employed. The things that you mentioned do not come under cheating in your case.

You are overthinking. It is really no issue at all.

Thank you for responding. I was thinking the same, so I changed my job and started working for another company for less money and also doing less hours.

But, just because there has been a considerable drop on salary soon after obtaining ILR. So, I was a bit confused. One of the immigration advisor I visited today also said, It might be questioned by home office, if they realise these things.
Whatever done has been done. Nothing I can do now. I left the sponsor too soon. All I can do cross my finger for positive decision for my wife's extension.

You really are overthinking this and your immigration advisor is over cautious too.
