Dependant Tier 2 extension, main applicant on ILR

Post by Amir63 » Sat May 04, 2019 1:11 pm

Hi,

I have received my ILR (based on Tier 2) Feb 2019 and my wife is on Tier 2 dependent visa expiring in March 2020. She will be eligible for ILR October 2020.
My wife is working currently but her contract finishes in March 2020 because of her visa expiry as her job is permanent.
She now wants to extend her contract (and also visa) to be eligible for maternity leave but there are still 10 months remaining on her current visa, so our questions is whether she can apply for the 3 years extension now or she must wait until 3 months before her visa expiry?

My understanding is that she can apply at any point for a 3 year extension. Her employment is obviously irrelevant.
