Tier 2 Dependent Visa for Baby

Hello All, I have a quick question, I am on Tier 2 General visa valid till 2020. My baby was born here in UK and we have applied for his Tier 2 Dependent visa here in UK.

Application was made by my company lawyers and all payment etc was done and documents were uploaded.
2 Weeks ago bio metrics of the baby was captured in Sopra steria office in Croydon. They captured baby photos etc and scanned his passport and returned it back to us.

My questions are as follows:

1. How much time it takes for baby visa application in normal processing - 6 weeks / 8 Weeks / 10 weeks from date of submission.

2. Application once submitted - can we make it express processing.

3. My wife wants to travel with baby to India, now we have the baby passport as well. But my company lawyers are saying that we cannot travel till we get the baby BRP and application will be considered withdrwawn. But I am not sure why is this rule and how will they find out if wife and baby left UK.

4. I am thinking - my wife and baby can travel to India first and I can collect BRP once ready and join them in India and we can all return together.

Please advise, as I am not getting any answers from company lawyers but only a standard reply.

1. It depends entirely on what service was selected and paid for. If standard service, it can take up to 8 weeks, sometimes a bit longer.

2. No you cannot.

3. Correct, if you leave the UK the application will be considered withdrawn. The Stupid share departure information with HO so they will know that the applicant has left.

4. Your choice if you want to take the risk.

Thank You for your response - is there any workaround for the same - as my wife really needs to travel to India with the baby - we have a situation at home - is there any application that we can make to the home office etc... or if she travels to India - we need to make a fresh application from India.

If the applicant leaves the UK and the application is withdrawn, you will have to reapply for a visa in home country and pay the fees again.

Useful to find out if the lawyers applied using standard, priority or super priority etc etc.

Thank you for your message - Lawyer applied in Standard service - I am now kicking myself for not applying in Priority earlier. Lesson learnt for future.
