Under Tier 2 visa application process but being made redundant

Post by maemaet » Mon Apr 01, 2019 9:58 am

I've submitted my Tier 2 visa application early this year switching from Tier 4 Student. While I am still waiting for the decision from home office as I am using standard new service, my company just announced it will close down the office in two months and all staff will be made redundant.

I was wondering what I should do next. The company will just close the office but the business entity will still be there. Can anyone please provide some insights?

If everyone is being made redundant then the business is no longer operating. They will no longer have access to a Sponsor licence so your application may be granted before all that happens. If you get your visa granted before they close then once it does happen then your visa will be subject to curtailment. This will give you a period of time to get another role.

If the company closes before your visa is granted or they withdraw sponsorship because they are closing then you are in a different position. Your visa will be refused and you will have 14 days to leave or make a new application.

Have you confirmed with your sponsor that they have not withdrawn the COS?

Thank you very much for the reply. I spent some time to figure out what's going on with my company.

The company is shutting the current office location but not the practice. Therefore the company still exist and the TIER 2 visa sponsorship license is valid till the end of year 2020. My employer is planning to keep me working with them at home and allow me to find a part time job with other company.

I submitted my visa application in January. But I haven't got any result yet, and my certificate of sponsorship is already in process and not possibly being withdrawn.

I've contacted the UKVI contact centre for a progress update but I only received a message listed below:
----------------------------------------------------------------------------------------------
Our records show your application has not yet been completed.

We are unable to advise when a decision will be made but you will be notified in writing once made. Until such time, we are unable to assist further. Should the caseworker require further information and/or documents they will contact you.

We are sorry we cannot be of further assistance at this time.
---------------------------------------------------------------------------------------------
So I was wondering if it's still possible for me to look for other opportunity and work part time for other company? Or if I find a job overseas is it okay for me to leave without getting the result and my money back?

Or, if I find a new company that is willing to hire me in the UK and sponsor me work visa in the UK, what would be the lowest salary requirement for the TIER 2 route for successful TIER 2 applicant? Would that be 45,000-55,000? (P.S. my current rate is the new entrant rate as i switch from tier 4 to tier 2)
