Appropriate Visa Category and ILR

Post by yashrai1209 » Mon May 13, 2019 1:24 pm

Hi,

I was in the UK from March 2015 till September 2018 on a ICT Tier 2 visa. I left the UK but was employed by the same company in their EU subsidiary on a EU Blue Card work permit. I now have the option to get back to the UK post my cooling off period. Few questions:
1. Since I left the UK in September 2018 so my cooling-off period will still be 1 year i.e. ending on September 2019?
2. What will be the most appropriate visa category for me i.e. Tier 2 General or something else
3. When can i apply for ILR and will my time spent on ICT Tier 2 will count?

Thanks.
Yash

1. Yes, it starts from the date you left the UK and you will be required to submit evidence of this, ie boarding pass etc.

2. You only have the option of tier 2. Whether your sponsor can sponsor tier 2 general depends on their licence and if they have both tier 2 ICT and tier 2 generals licence.

3. No, your time on ICT does not count for ILR based on 5 years residence.
